Introduction

Concentration Heat And Momentum Limited (“CHAM”) is aware that those including Clients, Software and Technical Support Users, recipients of CHAM technical and marketing information, those attending training courses, visitors to CHAM websites, and others need to know that CHAM takes seriously how personal information is collected, protected, used and shared.

 

Please read this, CHAM’s Privacy Policy, which has been updated to stress CHAM’s commitment to its responsibilities and to reflect the requirements of GDPR legislation coming into effect in May 2018.

 

This Privacy Policy covers:

 

  1. provision of personal data to CHAM electronically, via email, telephone, hard copy or other method;
  2. provision of personal data to CHAM Websites which may be accessed via www.cham.co.uk;
  3. provision of personal data by those who use products or services provided by CHAM by placing orders or requests electronically, via email, telephone, hard copy, via the website or through other routes. This includes those who purchase, and pay for, CHAM Software Products, access Technical Support Service, receive CHAM / PHOENICS Newsletters, receive CHAM marketing materials or request any publication from CHAM;
  4. provision of personal data by CHAM current and former employees and job applicants;
  5. information provided to CHAM by email, telephone, hard copy or any other format including, but not limited to, requests for quotations, requests for goods and services, requests for product information, articles for the Newsletter, CV data.

 

It describes how CHAM collects, protects and uses information received by Concentration Heat and Momentum Limited (CHAM) whose head office is at Bakery House, 40 High Street, Wimbledon Village, London SW19 5AU, United Kingdom.

 

Those who provide information to CHAM (whether directly via emails, telephone, or hard copy, via the CHAM websites or via social media outlets) by so doing agree to the terms of this Policy.

CHAM does not knowingly collect or solicit personal information from anyone under the age of 16 or knowingly allow such persons to register for Products or Services.

 

Information Collected

 

Most information collected by CHAM is provided by those approaching CHAM or being contacted by / contacting CHAM via email, telephone, hard-copy format, via the website or other format. Personal information is collected from those requesting quotations for software products, services or technical

support, placing orders for CHAM software products, services or technical support, registering for an event or training session, providing feedback, sending email enquiries, accessing social media sites, participating in surveys, or applying for positions advertised on the Sites.

 

Clients, and those approaching CHAM, may be asked for personal information including, but not limited to, name, job title, email address, postal address, postcode, job title, daytime and/or mobile phone number, credit/debit card information (when ordering products only) and information about workplace and nature of business. Personal information must be provided to order goods, create a user name and password, etc.

 

When products are ordered CHAM may wish to verify that use of the product is appropriate according to licence agreements in place. If CHAM finds that use of its products is not licenced that information may be shared with companies and organizations dealing with unlicensed access to software.

 

If Clients request that CHAM connect with other sites (for example social media) information may be gathered in that way.

 

CHAM websites may be visited anonymously but CHAM’s Products, Software, Services, Training sessions, Publications, etc may only be obtained by providing information mentioned above.

 

CHAM may file emails received (in digital or hard copy) and record telephone calls for processing orders and requests, training and quality assurance purposes.

 

CHAM receives information provided by current and former CHAM employees and job applicants during the process of applying for and (where relevant) being appointed to a position. If there are queries regarding how these data are processed or handled please contact privacy@cham.co.uk.

 

Use of personal information

 

Personal information collected as outlined in this Privacy Policy is used for purposes including:

 

  1. providing Clients and Users with services, products, support or information;
  2. providing after-sales services including, but not limited to, user support under maintenance;
  3. providing information about updates and improvements to products and services;
  4. managing CHAM’s relationship with Users and Clients and carrying out associated administration;
  5. dealing with enquiries and requests from companies and individuals;
  6. administering orders and accounts relating to clients and customers;
  7. administering client and user accounts;
  8. providing, developing, improving and personalising CHAM’s services and its Websites;
  9. generating anonymous reports about use of CHAM products, services, websites, etc.

 

CHAM may make contact using personal information collected to distribute product availability or update information, service provision data, technical newsletters, policy change notifications, training course dates, marketing material, etc by email or other means. Those in receipt of such communications may opt out of this facility by contacting CHAM on privacy@cham.co.uk. It may take a short time to implement such a request.

 

Sharing Information

 

CHAM has never, and will never, rent, sell or in any way pass on information to third parties except as required by law and detailed in our published Privacy Policy.

 

CHAM discloses personal data to enforce policies, comply with legal obligations or in the interests of security, public interest or law enforcement in any country where we have a branch or Agents. CHAM may also disclose data in connection with actual or proposed litigation, or to protect its property, security, people and other rights or interests.

 

CHAM shares information with third parties who help deliver CHAM products and services. Examples include hosting web servers, analyzing data, providing marketing assistance and customer services. These companies, or individuals, may access personal information as necessary to perform relevant functions but may not use those data for any other purpose. CHAM may share personal data with a third party – such as social media sites - if those providing personal data ask CHAM to connect with their account.

 

If CHAM websites are accessed through a hyperlink from the website of one of CHAM’s trading partners those accessing via this route consent to personal details and purchase information being shared with that trading partner in accordance with CHAM’s contractual relationship with them.

 

It should be remembered that when information is shared publicly, for example a blog comment, it may be indexable by search engines which may mean that the information is made public.

 

If CHAM, or any part of the group, is sold, or some of its assets transferred to a third party, personal information, as a valuable asset, may be transferred to the acquirer, even if they are not in the same line of business. CHAM’s customer database could be sold separately from the rest of the business, in whole or in a number of parts. Potential purchasers and their advisors may have limited access to data as part of the sale process. Similarly, personal information may be passed on to a successor in interest in the unlikely event of a liquidation, bankruptcy or administration. However, use of personal information will remain subject to this Privacy Policy.

 

Third Party Links and Services

 

CHAM websites contain links to other websites, including, but not limited to, CHAM overseas Branch, Agents and Resellers. These websites are not covered by this Privacy Policy and CHAM is not responsible for the privacy practices within any of these other websites. All accessing those Websites need to be aware of this and read the privacy statements of other websites.

 

CHAM may use Google to gather statistics on Website access. This may involve the use of cookies. Google may aggregate data collected from their various services not listed here. Users acknowledge and accept that CHAM has no control over such data collection and should look at their privacy policy for details of their data collection practices and use of cookies. If CHAM is asked, by Clients, to share data with third party sites (ie social media), the servers may not be secure.

 

Security and confidentiality

 

CHAM protects personal information as it is kept digitally on an in-house server rather than on the website. Hard-copy details are retained on file in the building which is secured at all times to the degree required by good business practice and insurance conditions.

 

CHAM protects personal information by not sharing it with anyone. However, despatching items means putting an address on the outside of a package so, in that way, your address is shared with the Royal Mail or a courier.

 

CHAM safeguards the security of personal information provided by taking what it deems to be appropriate measures to protect against unauthorized access, accidental loss, etc. No system is completely secure but CHAM will make every effort to prevent unlawful processing of personal data including restricting in-house access to the database. CHAM will not sell, trade on, or provide such data to any third parties other than under the circumstances described above or unless such disclosure is required in order to provide a requested service to fulfil an information request, to comply with a legal requirement or request from a competent court, regulator or other authority, or if it is believed that there has been a violation of CHAM’s Terms and Conditions or Company rights. Any information passed to a third party service provider will be held securely by that party and used only to provide the services or information requested.

 

Those who access the Sites are responsible for logging off from the Sites when not using them, keeping access information secure (unique password and log in details as appropriate) and maintaining good internet security. Should it seem that there has been a breach of security on the Sites then CHAM should be advised, immediately, as appropriate.

 

CHAM endeavours to protect Client and User privacy but cannot guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors beyond normal control, may compromise the security of information at any time.

 

CHAM is not responsible for privacy policies and/or practices on other websites. When following a link to another site Clients and Users should read that site’s privacy policy.

 

Cookies

 

CHAM does not, currently, use tracking cookies on its Sites although these may be used in the future and may currently be used by other websites accessed through the Sites. Users should always ascertain the policy regarding cookies of any third-party website thus accessed.

 

Social Networking

 

CHAM offers the opportunity to share or follow information about the Sites (or the products and/or services available through it).

Please note that CHAM does not endorse, or exercise any control over, the policies or practices of any third party social network whose functionality may be accessed through the Sites. The privacy policies of any social network accessed in this way should always be read carefully in order to understand their specific privacy and information usage practices.

 

How long does CHAM keep Information?

 

Personal data will be retained as long as is necessary for the purposes set out in this Privacy Policy, or as is required by applicable law, and then it will be deleted. User details have been retained since the point where goods or services were purchased and CHAM would expect to keep the information until Users request otherwise. If you wish details to be removed from my paper or digital records then please email privacy@cham.co.uk to make this request which will be processed as quickly as possible.

 

Internet Based Transfers

 

Given that the Internet is a global environment, using it to collect and process personal information necessarily involves international transmission of data. Territories outside the European Economic Area ("EEA") may not have laws providing the same level of protection for personal information as those inside the EEA. CHAM does not currently process personal information on servers or via third party service providers based in such territories. Should this change at any time every effort will be made to ensure that personal information is afforded the same level of protection as in the EEA.

 

 

Changes to this Privacy Policy

 

This Privacy Policy may be amended in which case CHAM will place an updated version on the Sites which version will be effective from date of publication. Continued use of the Sites indicates acceptance of any updates. Regular access to the Sites ensures Users are aware of information collected, how it is used and under what circumstances, if any, information will be shared with other parties.

 

This Privacy Policy was last updated on May 1 2018 and applies from that date.

 

Access to Information

 

The correction, updating or deletion of the personal information provided to CHAM may be requested by emailing privacy@cham.co.uk. CHAM will endeavour to respond to such requests within thirty (30) days. It will be necessary to provide a return email address to facilitate this.
